All my point is that certain criteria can be irrelevant and possibly unjustified in some circumstances and does not represent a virtuous disposition. I don't particularly like scousers (people from Liverpool, UK) but if he's a decent guy it would be unvirtuous not to hire him for example on the bas...

You are missing the point. Having a standard of justified or unjustified does not mean that those standards should be enforced by the state. Vices are not crimes. Who should decide which inputs (justifications) for an (inter)action (choice; discrimination; preference) are good, meaningful, or at all relevant? Should "society" (the state) determine whether propensity for farting is good, meaningful, or relevant input for one's decision to prefer one programmer...
